While You’re Away (WYA) is a service offered by Waitrose Ltd, part of the John Lewis Partnership. John Lewis Partnership is the Data Controller for any information you provide when you sign up to this service.
This privacy notice explains how we will collect and use your personal information when you subscribe to WYA. We update or amend this privacy notice from time to time to comply with law or to meet our changing business requirements. Changes to this privacy notice will communicate important information and we recommend that you check it regularly. By continuing to use WYA, you agree to the terms of this privacy notice, along with any updates and amendments.
Information we collect and what we do with it
Your privacy is important to us, and so we treat all of your personal information as confidential and keep it secure. We will only share your information with trusted third parties and in the circumstances set out below. We will never release your personal details to any company outside of the John Lewis Partnership for mailing or marketing purposes.
When you sign up via www.wya.waitrose.com, we will ask for your name, email, postcode and telephone number. Your information will be used for operational purposes only, including; to contact you about your acceptance or rejection onto the trial, to contact you about the service; to contact you to arrange the installation of your smartlock; or to confirm when you have placed a WYA order. When placing an order on www.waitrose.com, their privacy policy will apply which can be found here.
If a Yale Keyless Connected Smart Door Lock is going to be installed to enable the WYA service, your details will be securely passed to the John Lewis Home Solutions authorised locksmith who will contact you by telephone or e-mail to arrange installation of the lock. Our locksmith will ask to see a form of identification (driving licence or utility bill) before completing the installation.
The following information will also be collected for each delivery:
- On the day of Order, we will send a push notification reminding you to submit your smartlock code via the WYA app. We may send further Order reminders or updates via push notifications within the App. You may turn off push notifications via the native settings within your device, however, by turning them off you may miss important information about your Orders.
- The driver will be able to retrieve the code to your smartlock on arrival at the property via a secure JLP handset. In the event that the driver is unable to retrieve your code via the handset, a member of the Delivery team will contact you to discuss alternatives.
- We will never store your code past the day of Delivery and therefore you are required to update your code for each new Order.
Video recording of your deliveries:
- The driver will record a video of the delivery using a body-worn camera.
- You will be able to request the video after your delivery via the app and will be able to view your video within 2 working days from the request being made. You will have 10 days to watch this on your device until you will have to re-request the video.
- The video will be deleted from the camera by 11:59pm on the evening of the delivery once it is docked at the depot. At this point, it will be transferred to a platform where it will be securely stored with restricted access to JLP Partners.
- We will store the footage of the delivery for 3-months.
- The terms and conditions that you have accepted state that there should be no one in the property during delivery. As a result we don’t envision that we will record any individuals, however, if an individual is in the home, there is a possibility that they will be captured in the video recording. If an individual wishes not to be filmed, the delivery will be terminated immediately.

We confirm that any personal information that you provide to us (or which is available on public registers) and any user information from which we can identify you, is held in accordance with the registration we have with the Information Commissioner's Office. We use your information only for the following purposes:
- To process your order
- To securely complete the delivery inside your home
We may share your information with our carefully selected third-party data processors for the purpose of sending you operational communications. We may also be required to disclose your personal data to the police or other regulatory or Government body.
To provide you with the best possible service, we would like to keep you up-to-date with a range of products and services provided by WYA and/or John Lewis Partnership. This may include news of special events, promotions, product launches and catalogues. You can consent to us contacting you with this kind of information by checking the relevant boxes during registration.
We are constantly looking to improve our services, so we may occasionally contact you for research purposes by post, telephone, SMS text messaging and /or email. You can consent to us contacting you for this purpose by checking the relevant boxes during registration.
Access to your information and your rights
You have the right to request:
- Access to the personal data we hold about you, free of charge in most cases.
- The correction of your personal data when incorrect, out of date or incomplete.
- The deletion of the data we hold about you, in specific circumstances. For example, when you withdraw consent, or object and we have no legitimate overriding interest, or once the purpose for which we hold the data has come to an end (e.g. the end of a warranty).
- A computer file in a common format (e.g. CSV or similar) containing the personal data that you have previously provided to us and the right to have your information transferred to another entity where this is technically possible.
- Restriction of the use of your personal data, in specific circumstances, generally whilst we are deciding on an objection you have made.
- That we stop processing your personal data, in specific circumstances. For example, when you have withdrawn consent, or object for reasons related to your individual circumstances.
- That we stop using your personal data for direct marketing (either through specific channels, or all channels).
- That we stop any consent-based processing of your personal data after you withdraw that consent.
- Review by a Partner of any decision made based solely on automatic processing of your data (i.e. where no human has yet reviewed the outcome and criteria for the decision).

If we choose not to action your request we will explain to you the reasons for our refusal.
Your right to withdraw consent
Whenever you have given us your consent to use your personal data, you have the right to \change your mind at any time and withdraw that consent.
However, please be aware that you will be unable to continue with the service if you opt out or withdraw consent as it is required for the service.

Where we rely on our legitimate interest
In cases where we are processing your personal data on the basis of our legitimate interest, you can ask us to stop for reasons connected to your individual situation. We must then do so unless we believe we have a legitimate overriding reason to continue processing your personal data.

You have the right to stop the use of your personal data for direct marketing activity through all channels, or selected channels. We must always comply with your request.
Checking your identity
To protect the confidentiality of your information, we will ask you to verify your identity before proceeding with any request you make under this Privacy Notice.
If you have authorised a third party to submit a request on your behalf, we will ask them to prove they have your permission to act.
